U.S. judge says arrested Mexican 'DREAM-er' should get bail hearing

An executive order has already been drafted to end the program, Deferred Action for Childhood Arrivals, that allows hundreds of thousands of the immigrants to live and work openly in the U.S. Trump used that legal mechanism to great fanfare to expand deportation authority and restrict entry to the U.S. We've been following the case of Daniel Ramirez, a DACA recipient who was detained by immigration agents last week.

After Ramirez was arrested and taken into detention, an ICE officer asked if he'd ever been involved in any gang activity.

ICE said Ramirez was taken into custody "based on his admitted gang affiliation and risk to public safety".

Richeson declined to elaborate further on how ICE established the man was a member of a gang.

Instead, U.S. Magistrate Judge James Donohue said today Ramirez Medina can apply for a bond hearing before an immigration judge and that hearing must happen within a week.

"Information about the arrest of a DACA recipient last Friday remains scarce and questions remain unanswered by U.S. Immigration and Customs Enforcement (ICE)", the statement read.

Daniel Ramirez Medina, who was arrested Friday in Seattle from his father's home by U.S. Immigration and Customs Enforcement (ICE) officers, filed a challenge Monday to his detention in a Seattle federal court, arguing that the government violated his constitutional rights.

"The DACA situation is a very, very, it's a very hard thing for me because, you know, I love these kids", Trump said. "They shouldn't be very anxious", Trump said of the "Dreamers".

But Cortes Romero said that it was only after they had his client in custody that the tattoo raised their suspicions.

"I'm definitely takings his words lightly, and I nearly do not believe he will treat this issue with 'heart, '" said Luis Antezana, a 24-year-old Dreamer, who teaches a high school English class in Colorado Springs. "We're going to deal with Daca with heart".

He is concerned about the future of DACA, noting that the existing work permits will expire two years from now unless the new President chooses to continue the program.

The Obama Administration allowed 750,000 Dreamers, like Patricio Panuncio, to stay in the US and obtain work permits.

The fates of more than 700,000 undocumented immigrants, who earned deportation protections under the Obama administration, now rest in the hands of President Donald Trump.

The arrest is being seen as significant given Mr Trump's long-standing promise of an immigration clampdown.

"The Trump administration has continuously attacked immigrant communities", the rally's organizers wrote on the event's Facebook page.

United States immigration authorities arrested at least 680 people across the country last week, and a move against DACA recipients like Ramirez would represent a significant broadening of immigration enforcement under Trump. Ramirez was in custody and unavailable for comment.

In the early morning of 10 February, Medina was awoken by a US Immigration and Customs Enforcement raid on the home where he was staying in Des Moines, Washington, outside Seattle. And when agents later pressed Ramirez about gang involvement, Ramirez repeatedly denied any affiliation.

WONG:.So that individuals who committed violent crimes - they were the subjects of immigration enforcement actions and not other individuals who fell under those lesser priority categories.

Medina is one of more than 680 immigrants arrested and detained by immigration officials last week, including 41 people in the NY area.

"That calls into question the credibility of homeland security", Rosenbaum said.

PRESIDENT DONALD TRUMP: To me, it's one of the most hard subjects I have because you have these incredible kids in many cases, not in all cases. But one of Ramirez' lawyers, Mark Rosembaum, has said the allegations are false. The alleged felon appears to be Ramirez Medina's father, who was arrested at the same time, according to the young man's lawsuit. He paid a fee to register with the government, underwent an extensive background check and was granted a work permit.

Until Ramirez Medina is released and ICE and or the president publicly commit to protect Dreamers, you can expect more resistance from both DACA recipients and the general public alike. He was booked, fingerprinted and taken to a detention center in Tacoma.
