Trump Travel Ban 2.0 To Be Announced Monday

President Trump's revised restrictions on foreign travelers will allow Iraqis into the US and clarify that legal permanent residents are still allowed to enter the country, senior White House counselor Kellyanne Conway said, as the administration prepared Monday to issue a new version of its executive order that was blocked in the courts.

The initial January 27 order barred citizens of seven nations from entering the USA regardless of their legal status.

"Apart from the removal of Iraq, the new travel ban is essentially the same as the old travel ban, and has the same fundamental flaws - its choice of countries is arbitrary, its effect will be counter-productive, and its real goal is not improved security but meeting a campaign commitment to ban Muslims", said Rep. Adam Schiff, D-Calif., top Democrat on the House Permanent Select Committee. The order also limits the number of refuges the country can accept per year at 50,000 (after the 120 days are up.) Before, Syrians fleeing the civil war in their country were the only group "indefinitely" banned.

More than two dozen lawsuits were filed against the initial travel ban, which barred travelers from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen.

"This is not a Muslim ban in any way shape or form", a senior Department of Homeland Security official said Monday.

According to the fact sheet, the Department of Homeland Security will conduct a country-by-country review of the information the six targeted nations provide to the USA for visa and immigration decisions. Iraq has been removed from the original list at the urging of the Pentagon and State Department.

The net effect of these executive orders, whether they are upheld by the courts or not, is to create a continued environment of global uncertainty and fear that goes way beyond our borders and also beyond any specific countries.

In another change from the original order, Syrian refugees will not be subject to a permanent ban.

Critics immediately said the action was discriminatory and demonstrators flocked to airports to protest.

Iraqis who work with the US military are eligible for a visa category called the Special Immigrant Visa.

It comes as Nigeria has warned its citizens not to travel to the U.S. and says Nigerians with valid visas have been put on the next plane home.

A federal judge suspended the ban nationwide just a week later, much to the embarrassment of the Trump administration.

The Trump administration leans heavily on the rationale that refugees, as well as immigrants and travelers from certain countries, are a security risk to the United States.

The issuing of the initial order on January 27 sparked immediate chaos at airports across the country.

The new order represents a major political defeat for the Trump administration, which chose to shove aside the dozens of lawsuits that were filed after the first order was signed and just sign a new order.

The rollout of the revised travel ban marks an important moment for the administration, which has little room for error after the chaotic debut of the original plan. "No visas will be revoked exclusively based on this executive order", the FAQ says.

The new executive order will also ensure tens of thousands of Green Card holders would not be affected by the ban.

The Executive Order signed on March 6, 2017, allows for the proper review and establishment of standards to prevent terrorist or criminal infiltration by foreign nationals.

The administration has delayed the signing as it works with federal agencies that will be responsible for enforcing the new order.

"We are going to have a very smooth implementation period", said the official, who spoke to reporters on condition of anonymity.

Judges might not necessarily be persuaded by the Justice Department's arguments on that front, says Catherine Kim, a law professor at the University of North Carolina Law School. The administration announced that it would make revisions to the order while still fighting through an appeals process. Its scope was narrowed to address legal questions raised by federal courts, with the new version specifying that people who have already been issued visas, green-card holders and dual citizens won't be denied entry.
