Foxconn Uses Illegal Student Labor to Build iPhone X

Students have been employed illegally by Apple's main supplier in Asia in a bid to help the Cupertino-headquartered company deal with demand for new iPhone X, according to a report in The Financial Times.

Student labor is common in China, but workers must be paid, their positions must be voluntary, and they can not exceed working 40 hours a week.

Apple in a recent audit of its overseas manufacturing partners found that Hon Hai Precision Industry Co., part of Taiwan's Foxconn Technology Group and the exclusive assembler of the iPhone X, employed high school students that worked for more hours than local laws permit.

According to the Financial Times (via Bloomberg), the students worked at the factory as part of a three-month "work experience" stint that was required to graduate. When we found that some students were allowed to work overtime, we took prompt action.

Meanwhile, Foxconn said that "all work was voluntary and compensated appropriately, [but] the interns did work overtime in violation of our policy", which prohibits student interns from working more than 40 hours a week. "The work has nothing to do with our studies", Ms Yang said.

This isn't the first time that Foxconn has come under fire for less-than-ideal working conditions.

The report cited only six workers out of the thousands working at the facility.

Six of them told The Financial Times that they routinely worked 11-hour days, which is illegal under Chinese law.

In China, student labor is allowed, however it must be limited to 40 hours a week, and students must be paid or compensated with benefits, and their placements must be voluntary. Representatives of the school still has not commented on the situation.

"Apple actually knew about this a couple of weeks ago, however they haven't resolved the issue yet", Qiang added. Despite that framing, the Times report doesn't establish a clear or direct connection between these events. In 2012, there were reports of factory worker riots and use of underage workers, and both Apple and Foxconn agreed to work to improve factory conditions and share the costs of doing so.

According to CNET, an Apple spokesperson conceded the students should not have been working late.
