ZTE terms U.S. ban 'unfair,' says it endangers company's survival

It also noted the USA agency that conducted the investigation imposed the new ban "even before the completion of investigation of facts, ignoring the continuous diligent work of ZTE and the progress we have made on export compliance".

However, as the DOC enacted the ban because ZTE did not reduce bonuses and failed to reprimand 35 key employees by the deadline they were given, the company may not have much of a leg upon which their argument can stand. ZTE is crying foul and saying that the DOC is being unfair in its action and activated the ban without gathering facts.

Last month, USA telecom carrier AT&T abandoned Huawei phones under national security pressure from the USA government while Best Buy, a major electronics stores in the country, also said it will no longer sell Huawei's smartphones.

ZTE Corp., one of China's biggest tech companies, warned Friday that a ban on access to US technology threatens the company's survival and said it is looking for a legal solution.

ZTE on Friday issued its first statement regarding the Commerce Department's decision to ban the company from purchasing American hardware and software over the next seven years, not accounting for its initial comment which only acknowledged the measure was issued earlier this week.

That's a reference to the share price dips for USA companies Acacia Communications and Qualcomm in the wake of the ban, as both count (ed) ZTE among their larger clients.

ZTE statement insists that the company prioritizes compliance as the cornerstone of its strategy, citing an investment of $50 million in export control compliance projects in 2017 and plans to invest more this year.

Backstory: A trade war could be brewing, with tit-for-tat tariffs being applied by the U.S. and China, spurred by Donald Trump's concerns about China stealing American IP. However, the U.S.in 2016 said that while the investigation was going on, ZTE had made false statements in regards to disciplining employees who had been involved.

The Shenzhen-based company said it is determined to take all judicial measures to safeguard its legal rights and interests, while it will not give up efforts to resolve the issue through communication. "The action targets China, however, it will ultimately undermine the United States itself", said MOC spokesperson Gao Feng.

ZTE smartphones aren't the most popular, but can be intriguing.

In response, ZTE reiterated efforts it made to ensure compliance to U.S. export laws.

Progress has been made in closing the technological gap and chip makers attracted by the huge market potential are increasing their presence in China. China's ZTE went on to say, despite allegedly coming to an agreement over the finalized penalty, that such ostensible retribution is "unacceptable".
