'Mob rule' rocks US Senate hearing for judge

"Your job as Senate Democratic leader is to lead your caucus in complete opposition to Trump's attempted Supreme Court takeover", the letter continues. "It's a question, therefore, that's a hypothetical question that I can not begin to answer in this context".

The session quickly descended into turmoil with Democratic senators interrupting the Judiciary Committee's Republican chairman Chuck Grassley at the outset of the hearing and dozens of shouting protesters removed one by one by security personnel.

Kavanaugh sidestepped the question and did not address Guttenberg.

With majority Republicans appearing united, it's doubtful the hearings will affect the eventual confirmation of US President Donald Trump's nominee. And yet Kavanaugh ducks answering.

President Clinton was subpoenaed by independent counsel Kenneth Starr in 1998, and eventually agreed to testify voluntarily and the subpoena was withdrawn.

He differed with a White House characterization of his record on government regulations.

Democrats seized on Kavanaugh's comments in which he supported an expansion of a U.S. president's immunity from prosecution - a dramatic shift from his recommendation for strong action against then-president Bill Clinton when Kavanaugh assisted in a 1990s investigation against him.

Senator Dick Durbin (D-Illinois) basically accused Kavanaugh of lying at his 2006 judicial confirmation hearing when he denied being involved in discussions related to the detention of enemy combatants.

"No one is above the law in our constitutional system".

Trump has often criticized the federal judiciary.

However, he suggested that more details would be revealed at the Samsung Developer Conference scheduled for November 7 and 8. The exec added that the development process is "complicated", but that the company has "nearly concluded" it.

Kavanaugh mentioned the 1954 Brown ruling ending racial segregation in public schools and a 1974 ruling ordering President Nixon to hand over subpoenaed materials during the Watergate scandal as examples of judges making tough calls despite intense partisan pressures.

Kavanaugh, now a circuit judge on the United States Court of Appeals for the District of Columbia Circuit, will also praise his colleague Judge Merrick Garland, President Barack Obama's unsuccessful Supreme Court nominee.

In a preview of the tough questions Kavanaugh will face Wednesday, Democratic senators said they would press the judge on his views about abortion, gun control, and executive power. Democratic senators urged the committee adjourn because the White House released additional documents Monday night from Kavanaugh's time with the George W. Bush administration.

In a tweet on Tuesday morning, Harris claimed, "The truth is Republicans are rushing through this hearing because Kavanaugh is the least popular nominee in decades and the more the public learns about his record, the less they want him confirmed to the highest court in the land". And on the most contentious cases, the court tends to split into two sides, conservative and liberal. Senate Democrats have vowed a fierce fight.

The Republicans have a razor-thin majority in the Senate but are nevertheless expected to have the votes to confirm Kavanaugh before the midterm elections in November.

During day two of his confirmation hearings Wednesday, Kavanaugh referred to the landmark 1973 Supreme Court decision legalizing abortion as an "important precedent".

Trump picked Kavanaugh, 53, to replace Justice Anthony Kennedy, who announced his retirement in June.

The protesters, who were predominantly women, repeatedly heckled the senators and Kavanaugh, arguing that installing Trump's second pick to the Supreme Court would irreparably end access to abortion and dismantle the Affordable Care Act.

If all goes according to Republicans' plans, the committee will vote later this month - nearly surely along straight party lines - to send his nomination to the full Senate in hopes of getting him on the court by the October 1 start of the 2018 term.
