High court won't revivepolicy limiting asylum

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissented, and would have allowed the administration to begin enforcement of the president's order immediately. The administration has sought ways to block thousands of Central American men, women and children travelling in caravans to escape violence and poverty in their home countries from entering the USA, with Trump calling the people in the caravans a national security threat.

That ruling prompted Trump to disparage Tigar as an "Obama judge". But under the new policy, immigrants who cross into the United States illegally from Mexico would be ineligible for asylum.

Solicitor General Noel Francisco told the Supreme Court that the policy had important goals - "channeling asylum seekers to ports of entry for orderly processing, discouraging risky and illegal entries between ports of entry, reducing the backlog of meritless asylum claims, and facilitating diplomatic negotiations".

The narrow 5-4 ruling on Friday, with Chief Justice John Roberts siding with his four more liberal colleagues, left in place lower court rulings that blocked a proclamation by President Donald Trump in November denying asylum to those entering the country from Mexico, without going through official border crossings, Xinhua reported.

Trump's order bars entry and asylum proceedings for illegal migrants who enter the U.S. from Mexico. The statute says an asylum application must be accepted from any alien "physically present in the United States or who arrives in the United States whether or not at a designated port of arrival. irrespective of such alien's status".

Last month, Roberts had rebuked Trump for his criticism of the judiciary and spoken out strongly in defense of its independence: "We do not have Obama judges or Trump judges, Bush judges or Clinton judges", Roberts had said.

Immigrants rights advocates said the president did not have the legal authority to change the law on his own.

While crediting Trump for his "willingness" to improve relations with the North, also known as DPRK, Pyongyang accused the U.S. Administration officials have said for months that they are pushing for a second Trump-Kim summit, although Mr.

U.S. District Court Judge Jon S. Tigar of the Northern District of California agreed, implementing a temporary restraining order on the ban, an order the 9th Circuit upheld.

"For nearly 40 years, Congress has not disturbed the fundamental rule that an individual fleeing persecution can apply for asylum between ports, even when the number of apprehensions between ports was significantly higher", the groups argued.

ACLU attorney Lee Gelernt praised the decision.

The Supreme Court denied the administration's request for a stay of a nationwide injunction that had blocked the new asylum restrictions, report the New York Times, the National Law Journal and the Washington Post.

"We are pleased the court refused to allow the administration to short-circuit the usual appellate process", he said.

Although the legal fight isn't over, the high court rebuff of Trump's request to block the order suggests skepticism about the administration's legal case.
