Trump's battle with 'Obamacare' moves to the courts

Trump’s group health plan rules struck down by judge

Republicans on Capitol Hill pointed to association health plans this week as their policy alternative for more affordable health care than the plans sold under the Democrats' health care law.

The GOP turmoil over health care has come as a boon to Democrats, who are looking to change the subject from special counsel Robert Mueller's conclusion that the Trump campaign did not conspire with the Russian government to sway the 2016 election.

U.S. District Court Judge James E. Boasberg in Washington, D.C., last week blocked Medicaid work requirements in Kentucky and Arkansas approved by the Trump administration.

"These association health plans, the number of people that are signing up for them is pretty big", Wyoming Republican Sen. Initial estimates said 3 million to 4 million people eventually would enroll, compared with more than 160 million Americans covered by current employer plans.

"Without Tom pushing it, I don't think we would have had Romneycare", Romney said in an obituary for Thomas Stemberg, a Boston-based business exec who pushed for the health care overhaul. The Trump administration rules did not seek to supersede state laws regulating health insurance, and some states have limited the ability of companies to join the plans. He says Republicans are working on a replacement plan, but Congressman Peter Welch says that simply isn't true.

Key aspects of President Trump's health care agenda are struggling to overcome legal challenges in the courts.

On Tuesday, Trump told ABC News Senior Congressional Correspondent Mary Bruce that "the Republican Party will soon be known as the party of health care".

The lawsuit was brought by NY, 10 other states and the District of Columbia previous year.

"The administration will continue to fight for sole proprietors and small businesses so that they can have the freedom to band together to obtain more affordable, quality healthcare coverage", a Justice Department spokesman said.

He explained that he agrees with the administration that the ACA is unconstitutional, but if the courts rule that it is indeed unconstitutional, then that could create an immediate vacuum in the American health care system and toss millions of people off health care plans because of pre-existing conditions.

Also facing challenges in courts around the country are an administration regulation that bars federally funded family planning clinics from referring women for abortions and a rule that allows employers with religious and moral objections to opt out of offering free birth control to women workers as a preventive care service.
